WATER BAY VILLAGE – ST. THOMAS

WATER BAY VILLAGE
Overview
Water Bay Village is a townhouse-style condominium development with over 60 side-by-side units built in the early 1990’s. There are three different unit styles. On September 6, 2017, the property sustained extensive exterior wind and interior water damage as a result of Hurricane Irma. A claim was immediately filed with their insurance carrier and after many months of trying to handle the claim on their own, the Board of Directors reached out to Stark Loss Consultants for assistance.
Challenges
Stark Loss Consultants was retained by Water Bay Village in June 2018 to assist with the insurance claim when they felt settlement talks had stalled. Water Bay Village had received an initial settlement offer of $250,000 and had several contractor’s estimates that far exceeded this offer.
SLC quickly assembled a team of estimators and visited the property in early June 2018 to start preparing a damage evaluation. One of the greatest challenges SLC faced was the coordination to access the interior of over 60 units, several months after the storm. In many instances, the unit owners had left the island and were not planning to return as a result of the devastation brought on by the storm.
Once SLC had completed its repair estimate, a meeting was scheduled with representatives of the insurance carrier and settlement talks resumed. After another few months of inspections and discussions, the SLC team traveled to London, England to meet with insurance company representatives for two days to negotiate an acceptable settlement for all parties.
Results
SLC was able to reach a $2.2M settlement for the Water Bay Village, far exceeding the insurance carrier’s original settlement offer of $250,000.
ST. URSULA’S – ST. JOHN
Stark Loss Consultants (SLC) was engaged by the Diocese of the Virgin Islands on September 29, 2017 to represent their interests in the Episcopal Church, amongst others, on St John. The Diocese of the Virgin Islands consists of 14 congregations spread over five islands; St. Thomas, St. John and St. Croix – under U.S. jurisdiction, and Tortola and Virgin Gorda – under British rule.
ST. URSULA’S
Overview
Stark Loss Consultants (SLC) was engaged by the Diocese of the Virgin Islands on September 29, 2017 to represent their interests in the Episcopal Church, amongst others, on St John. The Diocese of the Virgin Islands consists of 14 congregations spread over five islands; St. Thomas, St. John and St. Croix – under U.S. jurisdiction, and Tortola and Virgin Gorda – under British rule.
A short walk from the ferry dock, the Church is located in the heart of Cruz Bay, St. John. This 12,000 square foot historic community center and place of worship was constructed with 12” concrete walls, large stained-glass windows, wood timber roof framing, and a metal roof deck. The lower level of the Church is used as primarily a community outreach center. The upper level consists of two naves, front and rear, with the front nave being the largest of the two, seating roughly 210 parishioners.
Challenges
The island of St. John is the smallest of the three United States Virgin Islands. Access to St. John is very limited and is restricted to private boat charter, ferry and car barge. Once on the island and in Cruz bay, travel to St. Ursula’s is easiest made by foot.
Notwithstanding the access restrictions to the loss location, clean water, food and shelter, SLC mobilized their team of experts who composed and presented a complete building and contents claim to Church Insurance of Vermont, insurer of St Ursula’s, within two weeks of formal engagement.
Shortly after presenting our claim to the insurer, SLC was notified of a settlement offer to the Diocese of roughly $350,000. Based on prior similar losses, the SLC team understood that restoration of the church would require a range of highly skilled artisans and tradespeople to apply their expertise, all of which were severely limited due to economic factors. The initial settlement offer, well below what was necessary for proper restoration, was promptly rejected.
Results
After several months of negotiations, SLC’s steadfast determination and commitment to quality restoration and accurate pricing, a settlement of $1.26 million was reached on behalf of the Diocese.
FIVE CORNERS PLAZA
Stark Loss Consultants was contacted by the property owner of Five Corners Plaza to assist with this insurance claim in December 2017. After his insurance company failed to respond to numerous requests to appraise the damages. The SLC team evaluated, prepared and submitted a comprehensive claim to the insurance carrier within one week of initial contact.
FIVE CORNERS PLAZA
Overview
Five Corners Plaza is a 30,000 square foot commercial multi-use property located in Christiansted, St. Croix, USVI. On September 17, 2017 the property sustained heavy wind damage to the exterior of the property and water damage to the interior leased commercial spaces due to Hurricane Maria. Most of the metal roofing was lifted off of the building and the roof-top mechanical air-conditioning units had been torn from the roof completely.

Stark Loss Consultants was contacted by the property owner of Five Corners Plaza to assist with this insurance claim in December 2017. After his insurance company failed to respond to numerous requests to appraise the damages. The SLC team evaluated, prepared and submitted a comprehensive claim to the insurance carrier within one week of initial contact.
Due to ambiguous language in the tenant lease agreement, it was difficult for the insurance company to determine whether the interior damage was the tenant’s responsibility or the building owner’s.
As part of SLC’s service agreement with the insured, SLC retained their commercial lease expert to evaluate each lease agreement. SLC then advised their client and his tenants of their rights under the leases as it relates to the insuring agreement. SLC’s expertise in interpreting commercial insurance policies combined with the report from the lease expert, resulted in both the insured and his tenants ultimately receiving the proper compensation for their respective damages.
Results
The insurance carrier initially offered $250,000 to settle this claim, which was substantially less than the repairs would cost the insured. Over the course of several months of communication with the insurance company’s adjuster and multiple site visits to the damaged property, SLC successfully settled the claim for $725,000, which allowed the insured to completely repair the property.
The insured subsequently revised all of his lease agreements to one standard form in hopes of avoiding future problems should another insurance loss occur.
